Medico-Legal Microbiology & Expert Witness Services

At Microbiology Consulting we provide specialist medico-legal microbiology expertise to solicitors, insurers and other organisations involved in civil litigation. We advise in cases involving a broad range of microorganisms and infectious diseases, with particular expertise in foodborne illness, gastrointestinal infection, travel-related disease, healthcare-associated infection and environmental sources of microbial exposure.  Drawing on extensive academic, research and applied microbiology experience, we provide independent, scientifically rigorous opinion to help establish what the microbiological evidence can, and equally importantly cannot, demonstrate.

Expert Assessment of Infection and Causation

Cases involving suspected infection can be scientifically complex. The identification of a microorganism does not, in itself, establish where or when an infection was acquired, while the absence of laboratory confirmation does not necessarily exclude an infectious cause.  Our role is to critically evaluate the available evidence and assess the balance of microbiological probabilities.

This may include consideration of:

  • Medical records and the clinical presentation of illness

  • Microbiological and other laboratory test results

  • The identity and characteristics of implicated microorganisms

  • Incubation periods and the chronology of symptoms and potential exposures

  • Epidemiological evidence and recognised patterns of transmission

  • Food, water and environmental exposure histories

  • Hygiene, infection-control and food-safety practices

  • Environmental and microbiological sampling results

  • Evidence concerning other affected individuals or outbreaks

  • Alternative microbiological and non-microbiological explanations for illness

Through this process, we can provide opinion on matters such as whether an illness is consistent with a particular infectious agent, whether a proposed exposure represents a plausible source of infection, and whether the available evidence supports a causal association on the balance of probabilities.

Food Poisoning and Gastrointestinal Illness

We have particular expertise in cases involving alleged food poisoning and gastrointestinal infection. These cases frequently require careful interpretation because several different pathogens may produce similar clinical symptoms, incubation periods may overlap, and microbiological confirmation is often unavailable. Establishing whether a particular meal, premises, holiday or other exposure was responsible therefore requires considerably more than simply identifying that gastrointestinal illness occurred. We assess the complete clinical, microbiological and epidemiological picture, including the timing and nature of symptoms, incubation periods, duration of illness, laboratory findings, potential food and environmental exposures, the presence of other cases, and evidence relating to food-handling or hygiene practices. Where the available evidence does not permit a reliable conclusion regarding causation, we make that limitation clear.

Travel-Related and Environmental Infections

We regularly advise on claims involving illness associated with hotels, resorts, cruise ships and other travel environments. Such cases may involve alleged exposure to contaminated food or water, swimming pools and recreational water, environmental sources of infection, or person-to-person transmission. We can assess whether the proposed circumstances provide a microbiologically credible mechanism of infection and whether the chronology and clinical presentation are consistent with the alleged exposure. Our expertise also extends to infections associated with water systems and the built environment, including cases involving organisms such as Legionella, and to the interpretation of environmental microbiology and contamination investigations where these form part of a legal claim.

Clear and Independent Expert Reports

Our medico-legal reports are structured, evidence-based and written to communicate complex microbiological issues clearly to both legal professionals and the Court. We distinguish carefully between established fact, scientific opinion and areas of uncertainty. Conclusions are supported, where appropriate, by peer-reviewed scientific literature, authoritative public-health guidance and recognised microbiological principles. We accept instructions from both claimant and defendant solicitors and understand that the expert's overriding duty is to assist the Court through independent and impartial opinion. Our expert witness work is undertaken in accordance with the requirements of Civil Procedure Rules Part 35 and the associated Practice Direction.

Support Throughout the Litigation Process

Our involvement can extend beyond preparation of the initial expert report. Depending upon the requirements of the case, we can provide:

  • Preliminary case review and advice on microbiological merit

  • Detailed expert reports

  • Review and comment on reports prepared by other experts

  • Responses to Part 35 questions

  • Expert-to-expert discussions

  • Preparation of joint statements

  • Conferences with solicitors and Counsel

  • Scientific literature review and interpretation

  • Advice on microbiological evidence and causation

  • Oral expert evidence where required

We can assist with individual claims as well as complex or multi-claimant litigation in which common questions of microbiology, infection, exposure or causation arise.

Scientifically Rigorous. Independent. Clear.

Effective medico-legal microbiology requires more than specialist scientific knowledge. It requires the ability to critically evaluate incomplete and sometimes conflicting evidence, understand the legal question being addressed, and explain complex microbiological concepts in a manner that is both accurate and accessible. Microbiology Consulting Ltd combines microbiological expertise with extensive experience of medico-legal casework, providing solicitors with robust, balanced and authoritative scientific opinion on complex questions of infection, exposure and causation.

Support for Industry & Healthcare

Microbiological issues can arise at every stage of product development, manufacture and supply. Microbiology Consulting provides independent, expert microbiology support to help businesses understand microbiological risks, resolve problems and make evidence-based decisions.  We work with organisations across a range of sectors, providing proportionate, practical advice grounded in microbiological science and extensive professional experience.

New Product Development

Understanding microbiological risk at an early stage of product development can prevent costly problems later.  We provide expert microbiological input throughout the development process, helping businesses assess the microbiological safety, stability and suitability of new products and processes.

Our support can include:

  • Microbiological risk assessment of new products and formulations including food safety management systems and HACCP.

  • Advice on likely microbial hazards and routes of contamination

  • Review of ingredients, raw materials and manufacturing processes

  • Advice on preservation strategies and microbiological stability

  • Development and review of appropriate microbiological testing programmes

  • Interpretation of laboratory and challenge testing data

  • Advice on shelf life and product storage conditions

  • Independent review of microbiological specifications and acceptance criteria

Our role is to ensure that microbiological considerations are incorporated into product development from the outset, helping to reduce technical risk and support confident decision-making.

Contamination Identification and Investigation

Unexpected microbial contamination can result in product failures, production disruption, customer complaints and potentially significant financial and reputational consequences.  We provide independent expert support to investigate contamination incidents and identify their most likely source.

This may include:

  • Interpretation of microbiological laboratory results

  • Identification of potential contamination sources and routes

  • Review of manufacturing processes and hygiene controls

  • Assessment of environmental monitoring data

  • Investigation of recurring or unexplained microbial contamination

  • Evaluation of water systems, equipment, raw materials and production environments

  • Review of sampling strategies and microbiological testing programmes

  • Assessment of the significance and likely origin of identified microorganisms

Where appropriate, we can work alongside your own technical teams, laboratories and other specialists to develop a clear understanding of the problem and determine the most appropriate response.

Remedial and Preventative Support

Identifying contamination is only part of the solution. Effective remediation requires an understanding of why the problem occurred and what changes are necessary to prevent its recurrence.  We provide practical, scientifically informed advice on corrective and preventative measures, including:

  • Development of contamination control strategies

  • Review and improvement of cleaning and disinfection procedures

  • Advice on environmental and process hygiene

  • Review of microbiological monitoring programmes

  • Identification of opportunities to strengthen process controls

  • Assessment of proposed remedial actions

  • Independent review following contamination incidents

  • Advice on verification and monitoring following corrective action

Our approach is based on addressing the underlying cause of microbiological problems rather than simply treating their immediate consequences.

Independent Scientific Expertise

Microbiology Consulting provides clients with access to microbiological expertise without the need for permanent specialist resource.  Whether you are developing a new product, investigating an unexpected contamination event or seeking reassurance that your microbiological controls are appropriate, we can provide independent scientific advice tailored to the particular circumstances of your organisation.
